Host U — Terms & Conditions
Welcome to Host U, a property management company specializing in short-term rentals. By booking a property through our website, you agree to be bound by the following terms and conditions. These terms are designed to ensure clarity and transparency regarding your rights and responsibilities as a guest. Please read them carefully.
These Short-Term Rental Terms and Conditions are entered into by and between Host U (hereinafter the "Host" or the "Company") and the "Guest." They set forth the rights and obligations of both Parties and govern the rental of the property located at [PROPERTY ADDRESS] (the "Property").
WHEREAS, the Host is the lawful owner or authorized agent of the Property and desires to rent the Property to the Guest for the rental period defined herein; and WHEREAS, the Guest has inspected the Property and agrees to rent it under the terms set forth below — NOW, THEREFORE, the Parties agree as follows:
1. Property Description
The Property, located at [PROPERTY ADDRESS], is a [DESCRIPTION OF PROPERTY]. The Property is fully furnished under the terms provided herein.
2. Term of Rental
The rental period shall begin at [4 PM Local Time] on [START DATE] and shall end at [11 AM Local Time] on [END DATE] (the "Rental Period"). The Guest agrees to vacate the Property by the check-out time unless otherwise agreed upon in writing. Any stay beyond this period may result in additional charges, as determined by the Host.
3. Property Condition — "As-Is"
The Guest acknowledges and agrees to accept the Property in its current "As-Is" condition. The Guest further acknowledges that:
- The Host has made no warranties, representations, or guarantees regarding the condition, fitness for a particular purpose, or suitability of the Property, except as expressly stated in these Terms and Conditions.
- Any existing defects, cosmetic issues, or malfunctions not reported within 24 hours of check-in shall be considered acceptable conditions of the Property, and no claims for refunds, compensation, or repairs shall be honored after that time period.
4. Payment and Security Deposit
The total rental amount for the Property is [TOTAL RENTAL AMOUNT], due and payable by [PAYMENT DEADLINE]. In addition, the Guest shall provide a security deposit of [SECURITY DEPOSIT AMOUNT], to be held by the Host. This deposit shall cover any damages, violations of these Terms, or additional costs incurred during the stay. The security deposit, minus any deductions for damages or fees, will be refunded to the Guest within [NUMBER OF DAYS] after check-out, subject to inspection of the Property.
5. Guest Responsibilities
The Guest agrees to use the Property responsibly and in compliance with all applicable laws, ordinances, and regulations, as well as the following:
- Respect for Property: The Guest agrees to treat the Property, its furnishings, and all common areas with care, and will be held responsible for any damage, loss, or excessive wear and tear during their stay.
- Occupancy Limits: The maximum number of guests allowed is [NUMBER OF GUESTS]. Hosting additional guests without prior consent is strictly prohibited and may result in immediate termination of the rental and forfeiture of all amounts paid.
- Quiet Enjoyment: The Guest shall not disturb the quiet enjoyment of neighbors or other tenants. Excessive noise, loud parties, or disruptive behavior is strictly prohibited and may result in termination of the rental without a refund.
6. House Rules and Condominium Regulations
The Guest agrees to comply with all house rules provided by the Host, as well as any rules of the condominium or homeowner association (HOA) governing the Property, including but not limited to:
- Noise Restrictions: No loud noise, music, or disturbances between the hours of [QUIET HOURS].
- Parking Regulations: The Guest shall park only in designated areas. Improperly parked vehicles may be towed at the Guest's expense.
- Use of Amenities: The Guest agrees to abide by all rules concerning shared amenities, including pools, gyms, and recreational areas. Improper or unsafe use may result in loss of access.
- Trash and Recycling: The Guest agrees to properly dispose of trash and recycling in the appropriate containers.
- Fines and Penalties: Failure to comply with any house rules or condominium/HOA regulations may result in fines, penalties, or other fees. Any such fees assessed against the Host due to the Guest's violation will be transferred directly to the Guest, who shall be fully responsible for any charges incurred due to their non-compliance.
7. Liability Waiver and Assumption of Risk
The Guest acknowledges that:
- Use of the Property and any amenities is undertaken at their own risk.
- The Host is not responsible or liable for any accidents, injuries, illnesses, or deaths that may occur during the stay — including, but not limited to, slips, falls, use of the pool, recreational activities, or use of any facilities or equipment on the Property.
- The Host shall not be held liable for any loss or theft of the Guest's personal belongings or valuables during the Rental Period.
8. Indemnification
The Guest agrees to indemnify, defend, and hold harmless the Host, the Property owner, and any of their employees, agents, or affiliates from and against all claims, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to:
- The Guest's use or misuse of the Property;
- Any violation of laws or regulations by the Guest or members of their party;
- Any negligent or wrongful acts by the Guest or members of their party during their stay.
9. Insurance
The Guest is strongly encouraged to carry travel insurance, renter's insurance, or other appropriate coverage for personal injury, property damage, theft, and other potential risks during the stay. The Host does not provide insurance coverage for any personal belongings, valuables, or the safety of the Guest while on the Property.
10. Force Majeure
Neither Party shall be liable for any failure or delay in performance due to causes beyond their reasonable control, including but not limited to natural disasters, acts of war, government actions, or any other force majeure event. In such an event, the affected Party must notify the other Party immediately and make reasonable efforts to mitigate the impact.
11. Reporting Issues and Defects
The Guest shall have 24 hours from the time of check-in to report any dissatisfaction, defects, or issues with the Property. Failure to report within this timeframe will be deemed acceptance of the Property as being in satisfactory condition, and no requests for refunds, compensation, or repairs will be entertained thereafter.
12. Early Termination and No-Refund Policy
No refunds will be provided for early departures or unused reservation days after the 24-hour reporting period has expired. Dissatisfaction with the Property after this initial period does not entitle the Guest to any refund, unless otherwise required by applicable law.
13. Termination by Host
The Host reserves the right to cancel the Guest's reservation unilaterally and without penalty if:
- The Guest violates these Terms and Conditions or any applicable laws;
- The Guest engages in dangerous, unlawful, or disruptive behavior;
- Emergencies or circumstances beyond the Host's control render the Property unsafe or unsuitable for occupation.
In such cases, the Guest agrees to vacate the Property immediately upon receiving notice from the Host.
14. Governing Law & Arbitration
- Arbitration: Any disputes, claims, or controversies arising out of or relating to these Terms and Conditions, your booking, or your stay at a Host U property shall be resolved exclusively through binding arbitration administered by a reputable arbitration body. Both parties waive their right to bring disputes to court, including the right to a jury trial.
- Process: Arbitration shall be conducted by a single arbitrator chosen by mutual agreement. If the parties cannot agree, one will be appointed by the arbitration body. Arbitration will take place in the county where the Property is located unless otherwise agreed.
- Costs: The costs of arbitration shall be shared equally, unless the arbitrator determines otherwise based on the merits of the case.
- Finality: The arbitrator's decision shall be final and binding, and may be entered into a court of competent jurisdiction for enforcement.
15. Amendments to Terms
Host U reserves the right to amend these Terms and Conditions at any time. Guests will be notified of any changes that may affect their booking.
